Used properly, telemarketing can be a lucrative marketing strategy for retail energy companies.  Misused, it can lead to significant legal exposure under the Telephone Consumer Protection Act (TCPA), which imposes penalties of up to $1,500 per call for violations, as well as other state and federal statutes.  Over the last few years, there has been a steady stream of TCPA class actions lawsuits and government enforcement actions filed against retail energy companies.  These actions often seek millions in damages and can result in significant business disruption and expense, even when meritless.  Ryan Watstein and Matthew Keilson are experienced TCPA defense and compliance lawyers who have defended hundreds of TCPA and related actions, including dozens against retail suppliers.  Drawing on that experience, in “Before You Call: Strategies and 2021 Updates to Avoid Telemarketing Lawsuits,” Ryan and Matt will address ways to minimize the risk of such lawsuits and investigations.  They will also discuss important recent TCPA developments from the Supreme Court and address how telemarketing compliance has become even more critical in the wake of COVID-19.
